The Biden Administration’s new Waters of the U.S. rule officially goes into effect today despite efforts to stop it.
Earlier this month, the House voted to repeal the rule. The Senate could vote on a similar bill this week. President Biden says he will veto the bill if it arrives on his desk.
An EPA Administrator says overturning the rule could bring unintended consequences. It would put the pre-2015 definition of WOTUS back into effect, removing the significant nexus standard as well as exemptions for artificial ponds for previously converted cropland.
