Court denies immediate halt of Dicamba use

Court action has denied a petition to immediately halt the use of dicamba herbicides.

The 9th Circuit Court of Appeals turned down the emergency motion and is allowing BASF and Corteva Agriscience to join payer in the case. The court wants to hear more from BASF regarding their request to have the judges recall and stay the mandate vacating the registrations.

The plaintiffs have until tomorrow to respond and farmers still have until July 31st to use up existing herbicide stocks.

The American Soybean Association praised the court decision saying, “Immediately banning use of existing stocks of Xtendimax, Engina, and Fexapan would have financially devastating consequences on America’s soybean growers, who have invested and estimated $3.35 billion for soybean seed in 2020.”
