Lawmakers seek to undo WOTUS rule

The Biden administration’s new WOTUS rule could soon be dead as U.S. House Republicans look to file a joint resolution of disapproval under the Congressional Review Act. Senator Chuck Grassley says an identical measure sponsored by 49 Senate republicans may get the democratic votes it needs to pass.

“Manchin’s already on board to do it, and Tester’s a farmer, he knows how this affects farming. I don’t know how it affects Montana—probably a smaller percentage. But Tester knows how it affects farming when you’ve got to deal with the U.S. government on farming regulations,” Grassley said.

Earlier this week the House Transportation & Infrastructure Committee passed a resolution calling for the repeal of the new WOTUS rule. This comes as the ag sector closely watches what the Supreme Court will decide in Sackett vs. EPA.

The high court has yet to hand down their decision but if they side with agriculture, it could force the Biden administration to withdraw the new rule and start over.
