Leading the Charge: One lawmaker prepares to fight EPA’s new WOTUS rule

At least one Republican is gearing up to fight the EPA’s new Waters of the U.S. rule.

Senator Shelley Moore-Capito of West Virginia says she will tackle it through the Clean Water Act. She plans to introduce a Congressional Review Act Resolution to overturn the regulation. It would likely succeed in the Republican-controlled House and would only require a simple majority in the Senate.

Because it is a resolution, Republicans could force a vote in the Senate despite opposition.
