Ninth Circuit Judges deny BASF’s request to recall dicamba ruling

A panel of judges on the Ninth Circuit court has denied the motion by BASF to stay and recall the June 3rd mandate vacating BASF’s Engenia herbicide and two other dicamba registrations, Bayer’s XtendiMax and Corteva’s FeXapan.

In a statement to Brownfield, BASF says they do not agree with the Court’s decision and will continue to pursue all legal remedies possible. It also says farmers must have access to the safe and effective crop protection solutions they have come to rely on. BASF says it will continue to pursue EPA registration of Engenia for the upcoming seasons.

Farmers and commercial operations can continue to apply any existing stocks of the herbicides as of June 3rd, for now, under the EPA’s cancellation order.
