There’s more legal action to come on the new WOTUS rule

More legal action could be on the way as the fight over the new WOTUS rule continues.

Just this week, U.S. District Judge Daniel L. Hovland granted a preliminary injunction halting the implementation of WOTUS in North Dakota and 23 other states.

Missouri’s Attorney General says the injunction filed this week in North Dakota means the lawsuit has merit. However, a final ruling is not expected until the Supreme Court hands down a decision in the Sackett case, which could be as late as June.

South Dakota’s Attorney General says Congress should address and find a more permanent WOTUS solution.
