Unconstitutional: AGs and ag groups are asking federal court to vacate Biden Administration’s WOTUS rule

Opposition to the Biden Administration’s Water of the U.S. rule coming back into the spotlight as 24 State Attorney Generals and several ag organizations ask a federal court to vacate the rule.

They say that the EPA and Army Corps of Engineers did not follow the Supreme Court’s ruling in Sackett v/s EPA.
That decision declared the Significant Nexus Test unconstitutional. EPA removed the test, but the group says that violated the Administrative Procedure Act.

Now, these states and ag groups are left looking for clarification on what constitutes a body of water and as such, which can be regulated by the federal government.
