Republican lawmakers sent a letter to the EPA voicing concern over actions that would expand its authority to regulate the Waters of the U.S. rule.
The group says the Administration is trying to side-step Congress in regulating the Clean Water Act, and points to a recent West Virginia versus EPA Supreme Court decision, which limited regulatory authority without congressional approval. The group says it will use its investigative authority to make sure decisions are made through Congress and not executive action.
The letter comes ahead of a WOTUS case that goes before the Supreme Court this fall.
