Tyson lawsuit to be heard in state court and not federal

A lawsuit against Tyson over COVID deaths can move forward in state court.

The plaintiffs argue Tyson was negligent at the beginning of the pandemic when four workers died at the Waterloo, Iowa plant. Tyson wanted the case to be heard in federal court, claiming it kept the plant open under the President’s federal order.

However, the 8th Circuit ruled Tyson failed to prove its case. The plaintiff’s attorney says that the ruling confirms the pandemic did not alter the legal principles of federalism.

Tyson now requires all employees to be vaccinated.
