WOTUS Showdown: North Dakota district court could halt new WOTUS rule

All eyes will be on North Dakota as a district court there will decide on a possible nationwide halt to the new WOTUS rule.

A federal judge there recently heard challenges from groups like the American Farm Bureau.

They joined 24 other states in their fight. This all comes after a federal judge in Kentucky denied the state’s attempt to stop WOTUS, but the rule has been halted in Texas and Idaho.

The ag industry is still waiting on the Supreme Court to rule on the Sackett case which could adjust the WOTUS definition nationwide.

There is no time frame on when the North Dakota district court will hand down its decision.
